RENTAL TERMS & CONDTIONS, WAIVER & RELEASE:

In renting and utilizing a bicycle, e-bike or other equipment from from JB BOARDS, LLC dba ARROW E-BIKES, I________(hereinafter, “Renter”) and any additional participants who may use this equipment expressly acknowledge and agree that the operation of an “e-bike” or any bicycle and other sporting goods equipment is an inherently dangerous activity, and that injury to myself or to others is an inherent risk arising from operating or being a passenger on a “e-bike” or bicycle. Therefore, I acknowledge and hereby agree that:

1. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of those persons released from liability below, and assume full responsibility for my participation in the activity and use of bicycles and e-bikes; and,

2. I agree to use the e-bike in a safe and responsible manner, and to follow all applicable traffic laws and regulations. I understand that the e-bike must only be used on paved surfaces, and that it is prohibited to use the e-bike on dirt or gravel trails, or in off-road conditions. E-bikes and bicycles may be ridden on hard packed, DRY SAND ONLY. NO SALTWATER OR WET SAND IS ALLOWED.

3. I certify that I am at least 18 years old, and that I am physically able to operate an e-bike. If I am under 18 years old, I acknowledge that I am renting the e-bike with the consent and supervision of a parent or legal guardian.

4. I acknowledge that I am responsible for any damages or loss of the e-bike that may occur during the rental period, including but not limited to damage from accidents, collisions, or misuse. I agree to pay JB BOARDS dba ARROW E-BIKES replacement cost of the equipment lost, stolen or destroyed.

5. I, for myself and on behalf of my heirs, HEREBY RELEASE AND HOLD HARMLESS JB BOARDS, LLC dba ARROW E-BIKES, the owners and lessors of premises used to conduct the e-bike rentals and other activities, their officers, officials, agents, and/or employees (Releasees), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, except that which is the result of gross negligence and/or wanton misconduct.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTANDING ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

6. The risk of injury from the activity and use of bicycles and e-bikes is significant, including the potential for permanent disability and death, and while careful operation and personal discipline will minimize this risk, the risk of serious injury does exist; I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of those persons released from liability below, and assume full responsibility for my participation in the activity and use of bicycles and e-bikes.

ATTENTION: $50 FINE/CLEANING FEE PER BIKE FOR RIDING IN SALT WATER AND SUBJECT TO ADDITIONAL FEES FOR REPAIR OF BROKEN E-BIKES OR BICYCLES.
